Commissioners direct evening public hearing on proposed zoning changes for gas stations, discount stores and vape shops

Deputy County Attorney John Houser and staff from Land Use and Growth Management presented a seven‑page memo and a draft ordinance responding to community concerns about perceived overproliferation of convenience stores, gas stations, small‑box discount retailers and vape shops in parts of Saint Mary's County.

Houser summarized options used by other jurisdictions — from a broad “public‑need” finding to precise dispersal setbacks or per‑capita limits — and recommended an approach that converts certain existing permitted uses to conditional uses so the Board of Appeals can assess case‑by‑case compatibility. "Conditional use also does give the board of appeals … some grounds to start inquiring into does the public need it, do it, and can be a little bit more sensitive and take a more scrutinizing eye," Houser said.

Why it matters: Staff said there are about 47 gas stations countywide and roughly 9–10 stores that might qualify as small‑box discount retailers; vape shops are more often changes of use and therefore harder to track. The proposed change would add public hearings and discretionary review for new locations in order to address neighborhood impacts such as traffic and concentration.

Commissioners voted to schedule an evening public hearing to collect public input; the originally proposed June 23 hearing was moved to July 14 to avoid Primary Day and to allow an evening meeting for broader participation. The motion passed by voice vote.
