Marcela Kresik, representing the property owner, said the trees are located within the footprint of a required stormwater retention pond associated with a flood-plain development application and that removal is requested so the approved retention facility can be constructed. Several council members said letters in the record were inconsistent about agency jurisdiction (one memo said the trees were not in wetlands; a later email suggested jurisdiction exists). Council members pressed staff to produce the full wetland history and any DEP/USACE correspondence and to confirm whether mitigation or enforcement is required before approving tree removal.
Public commenters urged the council to protect cypress for their stormwater and ecological value and asked whether the retention pond could be reconfigured to avoid tree removal.
Council voted 5-0 to table the resolution until staff could provide a full record of wetland jurisdiction, mitigation obligations, and the FEMA/FDOT/FDEP approvals or denials related to the property.
