Council approves zone change for 3350 S Highway 40 to commercial

The Daniel Town Council voted unanimously on June 1 to rezone a one-acre parcel at 3350 S Highway 40 from RA-5 to Commercial and adopted ordinance DO 2026-06-01A.
Planner Eric Bunker said the town's General Plan allows commercial uses along Highway 40 and that the Planning Commission recommended approval. During the public hearing, residents asked about why one acre is sufficient for commercial use while home sites require five acres (Bunker said the commercial zone is connected to sewer while homes rely on septic), parcel ownership and whether an entrance or exit onto Little Sweden Road would be possible.
Brian Myers, the applicant, was noted as owning the back parcel as well. Council members clarified that zone changes are voted on before any business plans or licensing; site plans and business licenses would be subsequent actions if the zone change were approved.
Councilmember Grady opened the hearing; Councilmember Walton seconded the motion to close it. The council then unanimously approved the zone change and adopted the ordinance, with a roll-call vote of Bennett yes, Walton yes, Grady yes, Rose yes, Kohler yes. Mayor Kohler read the ordinance into the record.
The rezoning allows the applicant to proceed to the next steps (site plans, permits, business-licensing) that would be required for any proposed commercial development along Highway 40.
