The Troy Planning Commission on July 8 voted to approve a minor amendment to the planned development (PD) for the Apex Center to allow installation of a composite privacy fence on the patio outside Ernest Cafe.
Presenter said Western Ohio Fence & Supply, on behalf of the Apex Center, requested the amendment to install 43 linear feet of 6‑foot composite fencing atop an existing 2‑foot retaining wall "to shield the patio area from high winds." The presenter told commissioners staff recommended approval because the amendment would not negatively affect the PD or adjoining properties.
Commissioners asked practical questions about installation. A committee member asked whether the posts would be mounted on the existing concrete and whether mounting would be allowable; the presenter and staff member said the fence will require a building permit because the combined height is 8 feet from the adjoining ground. The presenter said the building‑permit review will address post depth to meet frost‑line requirements and other structural details.
"They're required to have a building permit because it would be a total height of 8 feet to the adjoining ground," the presenter said.
After discussion, a commissioner moved to approve the minor amendment; the clerk seconded and the commission approved the application on roll call.
The planning commission’s approval is a recommendation under the PD provisions and does not substitute for any additional building‑permit approvals required by the city’s building department.
