Staff explained Valley Brook Road is a private road shown on the plat that created the rear portion of the Telfair subdivision; residents have a right to use the road and share financial responsibilities, while a separate property owner also has rights to use it but was not assigned maintenance responsibilities by the developer. Staff said this split of rights and responsibilities complicates permitting and construction access.
The applicant informed staff that it intends to propose a condition at the hearing to address possible road repairs if construction or use of the site damages the private road. "The applicant did inform me this morning that they intend to propose a condition at the hearing to address the possibility of making repairs to the road if there is any damage as a result of construction," a planning staff member said.
Commissioners noted the tower could improve cell coverage in an area that has experienced limited service — "even for 911 services, there has been a small area down there that they needed repeaters just to be able to get communications," a commissioner said — and that trip generation for maintenance would be very low (staff estimated roughly five trips per month for equipment servicing). The applicant and staff will bring a formal condition and additional detail to the public hearing.
No formal decision was made during the agenda review.
