Town counsel explained that the petitioner challenged assessments for tax years 2018 through 2023 (six years) and that both sides obtained appraisals that were not far apart. Counsel described a negotiated tentative settlement that reduces the assessment by 10% in each of the years involved. Because the property sits in the town’s unincorporated area, the town’s refund portion is larger than it would be for a village property; counsel estimated the town’s refund would be approximately $17,250 while the school district’s refund would be approximately $41,400.
Counsel also explained that certiorari cases can accumulate multiple years before being placed on a trial calendar and that the petitioner in this matter had accumulated several years before negotiating the settlement. The board discussed the relative size of the refund and noted it represented reductions spread over six years across four lots.
After discussion the board moved to approve the settlement for the town portion of $17,250; the motion passed on roll call.
