North Smithfield council authorizes attorney to deliver final offer in Pound Hill dispute, seals executive-session vote on separate case

The North Smithfield Town Council on June 8 authorized town counsel to return to Pound Hill Realty LLC with a final offer in ongoing litigation and indicated that a memorandum of understanding could be released to the public as soon as Thursday.

Council President said the town had presented an offer to Pound Hill Realty, that the developer returned a counteroffer the town rejected, and that the council had authorized attorney Robenheimer to deliver a final, time‑limited offer and await a response. "They came back with a counter offer, which we have rejected," the Council President said. He added the town had set a timeframe for Pound Hill Realty to respond and that the result could determine whether the council votes Monday on an overlay related to the matter.

At the meeting the council also entered an executive session under Rhode Island General Laws § 42-46-5(a)(2) to discuss litigation in Pinehill Realty, LLC v. Town of North Smithfield (case PC1999-1811). After returning to open session the council agreed to seal the executive‑session minutes and noted that a vote had been taken during the closed session; the public record shared at the meeting did not disclose the tally or the substance of that vote.

Council member who announced the return to open session said the minutes would be sealed and that one vote had been taken in executive session; no additional details were released at the meeting.

The council did not take any other public votes on litigation at the June 8 session. The next procedural milestones flagged by council members were potential public release of the MOU on Thursday and a possible Monday vote on an overlay, depending on Pound Hill Realty’s response.
