Planning commission approves vacation of small parcel near Branson Landing, easement to preserve utilities

A city staff member described the request as a cleanup following roundabout construction that left remnants of right-of-way no longer needed for public access and noted the parcel encroached on a nearby residential driveway. Staff said the owner/applicant is the City of Branson and Public Works Engineering, that public water and sewer lines and private utilities (Liberty Utilities and Summit Natural Gas) run through the area, and that staff drafted a general utility easement to be recorded concurrently with the street vacation to ensure continued access for utilities. The staff member recommended approval.
Applicant Blaine Orr told the commission he has treated the strip as part of his front yard since the roundabout work about 12 years ago and had not realized the formal vacation process remained incomplete. "It's part of my front yard. I've mowed it all that time," Orr said, asking the commission to formalize the arrangement; Orr also confirmed the easement agreement had been signed.
Following discussion, commissioners took a roll-call vote (names recorded in the meeting transcript) and approved the motion to vacate, 10 yes, 0 no. Staff said the Board of Aldermen will consider the item at a public hearing on Tuesday, Dec. 9, 2025, at 6 p.m. and that the easement document will be recorded at the time of the vacation to preserve utility access.
The commission’s action was an approval of the vacation request at the commission level; final action by the Board of Aldermen is required to complete the change in public right-of-way status.
