Planning Commission recommends owner–employee housing inside commercial buildings

The Brian Head Planning Commission voted unanimously to recommend that the Town Council add a narrow allowance to LMC §9-7-4 permitting a residential dwelling inside a commercial building envelope limited to owners or employees.
The Brian Head Planning Commission on June 16 recommended that the Town Council amend Land Management Code Section 9-7-4 to allow a residential unit located within a commercial building to be occupied only by owners or employees.
Greg Sant, the town's planning and building administrator, presented the amendment as a response to a prior request to mirror similar language already allowed in the Light Industrial Zone. After discussion about terminology and intent, Sant proposed final language to limit the use to units physically within commercial building envelopes and to restrict occupancy to owner or employee housing: "Residential dwelling within commercial building envelope for owner employee housing only."
Commissioner Thomas moved to recommend approval of that wording to the Town Council; Commissioner Morgan seconded. The motion passed 5-0-0 with votes recorded for Chairperson Deutschlander, Commissioners Morgan, Dever, Thomas and Lee, and Alternate Commissioner Robinson noted in the tally.
Commissioners said the narrower wording was intended to prevent property owners from placing a separate house behind a commercial structure and claiming compliance, and to preserve the need for a future Mixed-Use Overlay if the town wishes to permit broader residential development in commercial areas.
The Commission's recommendation will go to the Town Council for consideration; staff will transmit the proposed text and the meeting record as part of the formal referral.
