Salem supervisors approve Daniels’ storage yard and batch‑plant plans with extensive conditions after neighbor raises setback concerns

The Salem Township Board of Supervisors voted Dec. 18 to give final approval to the Existing Conditions Plan and preliminary approval to the Proposed Conditions Plan for a storage yard and concrete batch plant proposed by James Daniels on tax parcel 57‑19‑00‑0‑090, contingent on multiple required conditions.
The board’s approval is expressly subject to a list of revisions and permits, including labeling existing buildings and a 16‑foot wall on the existing‑conditions map; showing hydrant locations and the edge of the SR‑819 right‑of‑way; obtaining Township Engineer approval of a revised stormwater management plan; Westmoreland County (WCD) erosion and sedimentation control review; DEP/NPDES review or a DEP determination that no review is required; PennDOT Highway Occupancy Permit (HOP) and correction of an incorrect address on the HOP application; SEO and DEP approval of all on‑lot sanitary facilities; and adding revision numbers and dates to the plan sheets.
A key outstanding item is a request for a modification to allow an existing garage to encroach into the 40‑foot front yard setback; if the board approves the modification, a note must be added to the plan. The board also reserved the right to require isolation distances, buffering or screening and to require Township driveway permit approval for access onto Boggs Hollow Road.
Abutting property owner Lisa Segina questioned why an as‑built allows a structure apparently within the 40‑foot setback and asked when that issue would be resolved; supervisors said modification requests and accurate as‑built documentation must be reviewed by Planning and returned to the Board for final determination. The motions to amend and approve the plans passed unanimously.
