City legal staff briefed the council on the process for nominating and confirming municipal court judges and on qualifications and oversight for those positions.
The presenter explained that mayoral nominations come to council for confirmation, that municipal judges must complete training and periodic recertification through the South Carolina Supreme Court, and that the city adopted a local requirement in 2011 that municipal judges be attorneys. The presenter cautioned that once appointed, judges are part of the judiciary and governed by the state supreme court; the council does not exercise ongoing control over judicial decisions.
Council members debated whether municipal judges should be required to be attorneys. A retired judge on the council argued that nonlawyers can serve effectively with proper training and that requiring a law degree could narrow the pool unnecessarily. Others said the chief justice favors lawyers in the role and noted that urban jurisdictions often expect attorneys on the bench.
Councilors also raised transparency concerns for appointments and reappointments and asked that the mayor's office provide more background documentation and opportunity to vet nominees before confirmation votes. Legal staff said councilors can request resumes and other material and recommended using executive session for personnel matters when appropriate.
No individual appointment vote occurred at the session; legal staff said a previously tabled nomination could return to council at a later meeting or be discussed in executive session.
