The Hackberry Elementary School District #3 Governing Board approved revisions on Sept. 9 to Advisory Policy GCCC‑EC (Professional/Support Staff Leaves of Absence Without Pay) to ensure the policy aligns with the Family and Medical Leave Act of 1993.
Key changes the board adopted include adding an explicit job restoration clause to ensure employees exercising FMLA options are reinstated to their original or equivalent positions; revising wording to replace the phrase “most employees” with the clearer requirement that restored positions be original or equivalent; and removing language that suggested accrued benefits could not be used during FMLA leave where that conflicted with federal provisions allowing use of accrued leave.
Board members noted that some FMLA provisions listed in the policy do not directly apply to the small size of this district but were retained to match federal law verbatim. The motion to revise the advisory policy was made by Pam Adams, seconded by Valerie Grimes and passed 3‑0.
The revised policy will be incorporated into the district’s advisory policy register and implemented by Human Resources; the board emphasized clarity and compliance with federal requirements.
