Warner Planning Board adopts ADU ordinance edits citing NH RSA 674:72
Summary

Chair Karen Coyne opened the meeting and flagged two minor textual corrections to the zoning definitions, saying the ordinance should read “Accessory Dwelling Unit means either an (…)” and “Attached Dwelling Unit may be a new structure (…).”
Planning Board member James Gaffney told the board the town ordinance did not explicitly reference the state law and urged the board to include the RSA citation. “There is more in the RSA than is in the Town’s Ordinance,” Gaffney said, and he suggested adding language stating the town ordinance is pursuant to the RSA.
Pier D’Aprile moved, and Barak Greene seconded, to accept the two editorial changes presented by the chair; the motion passed on a roll-call vote with all members voting yes. Gaffney then moved, seconded by Greene, to add the phrase “Amended March 2026 as per NH RSA 674:72.” That motion also passed on a unanimous roll-call vote.
At the public hearing on the proposed edits to comply with RSA 674:72, Chair Coyne opened the hearing, noted there was no public comment, and closed the hearing. Barak Greene moved, and Ian Rogers seconded, to approve the ADU amendment to Article III (Definitions), Article IV (General Provisions), Article XIV-B (Accessory Apartment), and Table 1 (Use Regulations); the board voted unanimously to adopt the amendment.
The board did not receive public comment on the proposal. The amendment as adopted includes the corrected definition language and the added statutory citation; the minutes record the formal motions and unanimous votes.
