Bennet City Council approves consent agenda, curb-cut and maintenance-access waivers

The Bennet City Council voted on March 9 to approve its consent agenda and two property-access waivers that will allow private work on city-fronting access and maintenance to a shared well.
The council unanimously adopted the consent agenda, which included approval of the Feb. 9 minutes, claims for payment, the treasurer's report and Resolution 2026-3.1 approving a block party for BEDA’s Firefly Festival. Dan Zieg moved to approve the consent agenda and Pete Simmons seconded; the roll call vote was YES: Buck, Schmidt, Simmons, Zieg.
On a separate motion, the council approved a curb-cut waiver requested by Brandon Garvin. Dan Zieg moved and Jesse Schmidt seconded a motion to allow a curb cut not to exceed 12 feet in width with a paved approach. The roll call vote was YES: Schmidt, Simmons, Zieg, Buck, and the motion carried.
The council also approved a limited waiver to allow vehicular access from Saltillo Road to the Hunter’s Ridge Addition well house for maintenance. Josh Buck moved and Pete Simmons seconded the motion to waive relinquishment of direct vehicular access as set forth in the Final Plat for Hunter's Ridge dated Sept. 21, 2006 (Lancaster County Instrument No. 2006-052912), for the limited purpose of access to maintain the shared well located in the northeast corner of Lot 7. The roll call vote was YES: Simmons, Buck, Schmidt; ABSTAIN (with conflict): Zieg. The motion carried.
Procedural actions: Dan Zieg moved and Jesse Schmidt seconded a motion to enter closed session at 7:52 p.m. for the purpose of receiving legal advice; the council voted unanimously to enter closed session and returned to open session at 8:09 p.m. The meeting adjourned at 8:10 p.m.
The items approved include ministerial matters and site-specific waivers that allow property owners to make modifications or to provide maintenance access; the Saltillo Road waiver is narrowly limited to access for the well house maintenance and records the relevant Final Plat instrumental reference.
