SPRINGFIELD, N.H. — The Board of Selectmen on Sept. 23 voted to send attorney‑approved, factual language to a listing realtor to warn prospective buyers about wetland and shoreland buffer restrictions affecting a 2.5‑acre lot at Bowman Road and Main Street.
Zoning Coordinator Tim Bray told the Board that the current online listing describes the parcel in appealing terms but “could be viewed as highly misleading to a potential purchaser” given known wetland impacts and buffer zones. The town attorney provided three factual bullet points for Tim to use; the Board approved a motion by Chair Poul Heilmann, seconded by Selectman Steve Dzubak, authorizing Tim to send the language to the realtor and to post the attorney’s text on another realtor’s listing page as a factual advisory.
The Board also reviewed two separate Shoreland enforcement matters. Tyler Rowley (2380 Main St.) received a Notice of Violation on June 18 for constructing a stairway within the 100‑foot Shoreland buffer at Lake Kolelemook in violation of the town’s zoning ordinance. Bray reported Rowley plans to come to town hall to collect an abutters list and pursue a variance; town staff will continue the ZBA process and maintain the Superior Court complaint for the short‑term rental issue until the variance is pursued.
Separately, Tony Dopazo (21 Sandy Beach Rd.) remained under active enforcement stemming from a May 29 notice alleging violations of the Springfield Zoning Ordinance and NHDES Shoreland Water Quality Protection regulations. NHDES opened file #2024‑01491 and assigned inspector Sephera Michailides. Bray said the town’s attorneys issued letters and that Dopazo has until Oct. 3 to comply before the attorney files with the court.
The Board framed the realtor notification as a factual, non‑interventionist step to ensure prospective buyers are aware of constraints tied to wetlands and shoreland protections. The motion to authorize notification carried with Poul Heilmann and Steve Dzubak voting in favor.
What’s next: Staff will send the attorney‑draft language to the realtor and post the factual advisories online; Rowley is expected to pursue a variance, and town counsel will proceed if Dopazo does not comply by Oct. 3.
