The Town of Newburgh Planning Board on June 18 authorized circulation of adjoiners' notices and discussed next steps for an application to formalize an existing two‑family use at 29 Dandelion Lane.
Todd Maurizzio (Fusco Engineering & Land Surveying) said the structure at the end of the cul‑de‑sac had been converted from a single‑family with accessory apartment to a two‑family dwelling and that the applicant previously received three variances from the Zoning Board of Appeals. Maurizzio noted mapping corrections are needed on the bulk table and plan to reflect the correct variance dates and setback measurements.
Quinn Mullarkey recommended a dye test signed by a licensed engineer to demonstrate the existing septic absorption area can handle the flow of a two‑family dwelling. "A dye test would be acceptable just showing that the existing absorption area is adequate for the flows of the two‑family home, signed by a licensed engineer," Mullarkey said. Town counsel Dominic Cordisco advised that the prior ZBA decision was dated November 25 and, because its six‑month validity likely expired in May, the applicant should request a six‑month extension promptly.
Cordisco and staff noted that, under the Town’s memorandum with County Planning, duplex conversions on approved building lots are exempt from County Planning referral, so the Board did not need to send this application to County Planning. The Board authorized adjoiners’ notices and will place the item on the next available agenda pending the applicant’s ZBA extension request and required technical documentation.
Next steps: Applicant to provide dye test or engineer certification for the septic, correct mapping on the plan, and file promptly with the ZBA for a six‑month extension of prior variance approvals.
