Planning Board refers MKJC Realty amended site plan to County Planning and declines a public hearing

The Town of Newburgh Planning Board on June 18 moved to circulate adjoiners' notices and to refer an amended site plan for MKJC Realty to Orange County Planning, after the applicant removed a proposed second‑story storage area.
Scott Sicina of Lanc & Tully told the Board the amended plan is identical to the previously approved site plan except that the second floor was removed, reducing the building’s height from 35 feet to 25 feet. “The amended site plan removes the second story storage area from the structure,” Sicina said.
Quinn Mullarkey, the Town’s consulting engineer, asked that the EAF be corrected because it incorrectly marked the parcel as being within the Chadwick Lake critical environmental area; she requested that adjoiners' notices be circulated. Dominic Cordisco, the Board attorney, said that County Planning referral is required for this amended site plan and recommended sending the materials to Orange County Planning.
Board members discussed whether a public hearing was necessary and concluded the modification reduced the project’s scope; the Board voted not to hold a public hearing, but to circulate adjoiners' notices and refer the application to Orange County Planning for its review.
Next steps: Applicant will correct the EAF, provide required adjoiners' notices, and the Board will send the referral package to the County for advisory comment.
