Commission says proposed garage at 32 Hayward Lane needs more mitigation, continues hearing to Aug. 4

Eli of JC Engineering presented a revised plan for a detached garage at 32 Hayward Lane that added mitigation areas (bringing total mitigation to about 1,708 sq ft), increased tree plantings and proposed converting roughly 608 sq ft of gravel driveway to mitigation planting.

Commissioners questioned whether the mitigation proposed would meet the town’s performance standards for ACEC impacts and repeatedly urged the applicant to remove more lawn and hardscape and substantially naturalize the property — perhaps at a 2:1 or greater mitigation ratio — to justify adding a structure within the ACEC. One commissioner said the lot is "fully developed; border to border" inside the resource area and that adding a new garage would be a heavy lift for approval unless broad undevelopment and restoration occurred.

Given the commission’s concerns and the applicant’s need to consider more substantial mitigation or design changes, the commission continued the public hearing to Aug. 4, 2026. Staff and commissioners encouraged the applicant to consider removing additional structures or lawn, increasing the mitigation ratio and submitting clear cross sections and planting details.

Why it matters: new structures inside an ACEC carry a high protection standard; commissioners signaled that modest mitigation will not typically compensate for new development and asked for substantive landscape and site changes before reconsidering.

Next steps: applicant to return Aug. 4 with further revised mitigation, cross sections and a clearer plan to naturalize additional lawn and reduce developed footprint.
