Council narrows irrigation requirements, road connectivity and removes binding clause in Swiss Development agreement

City Attorney Justin Wayment identified unresolved items in the proposed development agreement with the Swiss Development. The primary discussion centered on pressurized irrigation: the Council tentatively agreed lots of 0.25 acres or larger should have pressurized irrigation connections while smaller lots could be xeriscaped, provided trunk lines are installed throughout the subdivision to allow future connectivity.
Staff also required Phase 2 to connect to Moldau Road rather than Minersville Highway because of property-ownership issues and removed proposed language that would have allowed the developer to apply the agreement to land not yet owned (language council said would bind future councils). The agreement includes a 25-acre park donation. Council did not finalize every clause at the June 17 meeting; staff and attorney edits were requested before the agreement is returned for final approval.
