The Bolton Inland Wetlands Commission issued a jurisdictional ruling on Oct. 22 finding that the installation of a wood lawn fence within 100 feet of a pond at 220 Hebron Road falls under the allowed "use and enjoyment" provisions of the town’s wetlands regulations (Section 4.1d).
Applicant Samuel Green said the fence was being considered because of tension between neighbors. Wetlands Agent Alyssa Barroso described the property as a large grass field with a large pond and few floodplain constraints. Chair Ross Lally determined the proposed wood fence appears allowable under the regulations but asked Green to ensure compliance with Planning and Zoning rules.
James Loersch moved to approve the jurisdictional ruling; Michael McDonnell seconded. The motion carried unanimously, 4–0–0.
The commission’s ruling is procedural rather than a permit decision; the applicant was advised to seek or confirm any Planning and Zoning approvals as required before construction.
