Forsyth council adopts resolution authorizing town attorney to negotiate settlement

Mayor Lilly moved and the Town of Forsyth mayor and council voted to adopt Resolution 55-25, authorizing the town attorney to enter negotiations for an alternative dispute resolution and permitting the town administrator to execute and fund any resulting agreement from FY2026 budget line 900971331. The mayor said the resolution was not on the published agenda and read it in full before the vote.

The mayor, who identified herself as Mayor Lilly, told the council the closed session had been held under “article subsection 3 dash 3 0 5,” citing reason 7 to consult with counsel about a specific matter of litigation. She said counsel recommended bringing a resolution into open session so the council could vote on addressing the litigation.

Reading the resolution, the mayor said the text “whereas the town attorney, Jason Deloche, is authorized to enter negotiations on behalf of the town,” and that the town administrator would be authorized to execute any potential agreement and make any agreed financial disbursements. The resolution text named FY2026 budget line 900971331 as the source for any disbursements. The mayor also read that the resolution “shall take effect immediately upon passage past this October 2025.”

After a member seconded the motion, the clerk called the roll. The recorded result was five yeses; the mayor announced the motion carries and the resolution was adopted. The mayor moved promptly to adjourn and closed the meeting at about 10:15 a.m.

The mayor announced the council will next meet in November and noted the town’s harvest day festivals on October 25.
