The Inland Wetlands Agency voted July 8 to approve application 260004 for soil excavation and remediation at 901 Route 12, finding no loss of wetland or watercourse and requiring erosion controls and other conditions.
Staff presented an updated site plan after a recent site walk showing excavation limits and several dead trees in the upland review area. A Committee member moved to approve the permit with four standard conditions and modifications that included requiring the limits of disturbance match the approved plans, marking and town inspection of any proposed tree removals, immediate town notification if soil testing indicates further excavation is necessary, and adding hay bales in addition to the proposed silt fence. The applicant was also required to work with staff to include additional plantings in the disturbed area.
An applicant representative described field and laboratory findings, saying post-excavation samples exceeded state cleanup standards and outlining the remediation steps: “We plan to excavate the whole area to about 2 feet deep, screen with a photoionization detector for volatile organic compounds, take additional post-excavation samples, place excavated soil on plastic pending waste classification, and then dispose of it at a properly approved facility,” the presenter said. He added the intention to backfill the excavation with loan material, compact with the excavator bucket, and apply geotextile and seed and to install erosion controls downslope of the excavation.
Members who attended the site walk described steep slopes and two standing dead trees in the remedial area and emphasized the need for strong erosion- and sediment-control (E&S) measures to protect the wetland and slope stability. Staff and the agency included explicit E&S language in the permit conditions and a requirement for staff inspection prior to work commencing.
The motion was seconded, members voted aye and the permit was carried. The applicant thanked the agency for acting promptly and agreed to coordinate with staff on planting and erosion-control details.
Next steps: the applicant must provide the final erosion and sediment-control plan showing silt fence and hay bales, notify the town immediately if subsequent soil testing requires additional remediation, and coordinate plantings with staff before work begins.
