Agency continues enforcement at 174 Shaker Road and closes June 9 violation for 13 Hillier Drive

The Inland Wetlands & Watercourses Agency took two enforcement actions: it continued an outstanding enforcement matter for 174 Shaker Road to the July 7 meeting to allow staff time to confirm removal of containers and mulch piles, and it voted to close the June 9, 2026 violation for 13 Hillier Drive (Map 18, Lot 277) as invalid given the evidence presented.

For 174 Shaker Road, staff reported the owner was given until May 31 to remove containers and mulch, and the items remained in place at the time of the report. Attorney Schober asked for time through the end of June to complete removal; staff said the alternative would be to pursue enforcement citations. The agency agreed to revisit the matter on July 7 for an update and potential escalation if the owner does not comply. The motion to continue carried 6–0.

At 13 Hillier Drive, staff described an anonymous complaint and showed photographs indicating clearing and equipment. Owner Thomas Brocuglio told the agency he owns both 13 Hillier Drive and the adjacent 51 Bridge lot and that the equipment pictured is currently stored on the rear lot awaiting permitting; he said no new clearing has occurred and that he has engaged a surveyor and Davidson Environmental for wetland delineation. Staff said no active clearing was observed during the site inspection. The agency voted to close the June 9 violation as invalid (6–0), while asking the owner to submit permit materials in time for the next meeting.

The agency asked staff to monitor both sites and report back at the July meeting; members also asked staff to work with the town attorney to produce a clearer enforcement procedure for future use.
