Fairview council approves conditional-use permit for auto-repair shop on Old Dutch Road

The Fairview Town Council on June 11 approved Conditional Use Permit #CUP 12-015 allowing Neil Ferrentino to operate a general auto-repair business at 811 Old Dutch Road, the former Denny's Muffler Shop. Mayor Elizabeth Long opened the quasi-judicial hearing and Ed Humphries, the town's land use administrator and clerk, explained the request and swore in speakers.
The applicant, Neil Ferrentino, presented conditions approved by the Planning Board. Council members added two amendments before voting: increase the permitted number of employees from four to "up to six" and require that tires held for disposal be covered. After taking the four required findings individually, the council voted 4-0 to approve the permit with those conditions and a statement finding the decision consistent with the Town of Fairview Land Use Plan (Revised Sept. 13, 2010) and the Town of Fairview Land Use Ordinance (effective July 1, 2005).
The council's recorded motions addressed the statutory findings: (1) no material danger to public health or safety because of the imposed conditions and environmental safeguards; (2) no substantial injury to adjoining property values, with council members noting a similar prior operation at the location and a petition of neighborhood support submitted by the applicant; (3) compatibility with the surrounding area; and (4) conformity with the town's land-use plans. Each finding was moved and passed 4-0, and the permit decision followed the same vote tally.
The approved conditions now on file (as presented to and amended by the council) include the Planning Board conditions plus the two council amendments: employee cap "up to six" and covered tire storage for disposal. Ed Humphries administered the public hearing and recorded that there were no public comments during the hearing.
The council's action grants the applicant the conditional-use permit subject to conditions approved in the meeting. Any compliance monitoring or enforcement would follow the Town of Fairview Land Use Ordinance and related local procedures.
