The Town of Enfield Board of Commissioners entered closed session several times in July and again in November to consult with the town attorney under North Carolina statute N.C. Gen. Stat. § 143-318.11(a)(3).
On July 22 and July 23 the board held emergency special-call virtual meetings at which the board moved into closed session to discuss attorney–client privileged information; the minutes show the board returned to open session and took no open-session action on the matters discussed. On Nov. 13 the board similarly voted to go into closed session, voted to return to open session and adjourned. The motions to enter and exit closed session were recorded with named movers and seconders in the minutes but the public record contains no substantive open-session decisions taken as a result of the privileged consultations.
Statute cited during the meetings was NC GS 143-318.11(a)(3). The board’s minutes show closed-session motions carried unanimously.
