Fairview council adopts three zoning text amendments on notice, wind and solar

The Fairview Town Council on March 12 adopted three amendments to the town's Land Use Ordinance aimed at clarifying notice procedures and regulating wind and solar energy facilities.
Ed Humphries, the town's land-use administrator, described the proposals. Text Amendment TC-11-054 requires that written notice be mailed to any property owner with any portion of their parcel located within 500 feet of the lot subject to a requested rezoning, using mailing addresses obtained from Union County tax records; notice must be mailed not later than 10 days before the hearing. Text Amendment TC-12-005 adds regulations specific to wind-energy facilities. Text Amendment TC-12-006 adds regulations for solar-energy facilities in farm and residential uses.
There were no public comments on the three items. Councilman Jerry Clontz moved to approve TC-11-054 and state that the amendment is reasonable and consistent with the Town of Fairview Land Use Plan (Revised Sept. 13, 2010) and the Land Use Ordinance; Arnold Price seconded and the council voted 4–0. B.B. Haigler moved to approve TC-12-005 (wind) and Arnold Price seconded; the council voted 4–0. Arnold Price moved to approve TC-12-006 (solar) and Bradley Purser seconded; the council voted 4–0. All three amendments were recorded with the council's finding of consistency with the town's land-use plan.
The changes require town staff to use Union County tax GIS mailing addresses for notices, and create a local regulatory framework for siting and operation of wind and solar facilities in specified zones. Implementation depends on staff updating public-notice procedures and applying the new standards to future rezoning and conditional-use applications.
