Fairview council approves conditional-use permit for kennel at 401 Clontz Long Road

The Fairview Town Council on March 12 approved a Conditional Use Permit for a kennel and boarding facility on approximately two acres at 401 Clontz Long Road.
Anthony Taggio applied for Permit CUP-11-050 to operate a 1,560-square-foot facility that the Planning Board recommended 6–1. The council adopted a set of conditions intended to limit impacts on neighbors: the kennel may house up to 20 dogs, provide eight parking spaces, include a public restroom and heating and air conditioning, be insulated for noise control, have its own well and septic system, place waste in a dumpster removed weekly, install a six-foot fence, plant shrubs to buffer noise, and operate Monday through Saturday from 7 a.m. to 7 p.m. Sunday pick-ups and drop-offs are allowed by appointment only. The business is barred from accepting aggressive animals and must comply with all state and county licensing requirements and local sign standards.
Ed Humphries, the town's land-use administrator and clerk, summarized the Planning Board conditions and administered the quasi-judicial hearing. The applicant submitted signatures from eight surrounding property owners in support. Town Attorney Joe McCullom asked whether the use would endanger public health or safety; Taggio responded, “No.”
Councilman Jerry Clontz moved to find that the permit would not endanger public health and would not injure adjoining property values, and that the use would be in harmony with the area and generally conform to the Fairview Land Use Plan. The motion to approve CUP-11-050 with the stated conditions passed unanimously (4–0).
With the findings recorded in the public minutes, the permit is authorized to proceed consistent with the stated conditions and applicable state and county licenses.
