Louisa County supervisors approve resolution to join Ports of Eastern Iowa Authority

The resolution cites Chapter 28J of the Iowa Code as its statutory authority and specifies the new authority would have powers under that chapter except eminent domain and zoning. It also states the authority’s board of directors will include one director from each participating political subdivision, with two-year terms for directors and rules for filling vacancies.
The resolution includes a condition on effectiveness: it “shall only become effective when at least three (3) of the remaining six political subdivisions adopts a like resolution and appoints its members of the initial board of directors,” language recorded in the adopted text. The resolution further specifies that liabilities of the port authority shall not become liabilities of the participating political subdivisions and that surplus funds contemplated by section 28J.13 would be distributed equally among participating counties that adopt similar resolutions.
The board’s action on Aug. 27 records AYES: Brad Quigley, Chris Ball and Shawn Maine. No opposing votes or abstentions were recorded in the minutes.
