Commission recommends Dietrich lot-line adjustment feasibility advance with restriction on further subdivision

Scot Dietrich presented a proposed lot-line adjustment for Marie A. Dietrich at the Lynn Township Planning Commission meeting on Feb. 18, 2025, saying the plan is “a rearrangement of 2 lots due to the will and testament of the deceased property owner.” The commission voted unanimously to recommend the feasibility study proceed to a submitted preliminary plan conditional on addressing the township engineer’s comments and adding a note that no further subdivision is permitted.
The commission’s township engineer, Karl Scherzberg, reviewed his Feb. 12, 2025 comment letter. He flagged the locations of septic drainfields and advised the applicant to check with SEO Ian Stout on whether additional testing is required; noted that no new driveways are proposed; said incorrect zoning data in the Site Data Table must be corrected; asked that the plan demonstrate there is no remaining area for future subdivision; and observed there is currently no proposal that would trigger NPDES because there is no planned ground disturbance. Scherzberg also noted the current impervious surface area on the property predates the Maiden Creek Stormwater Ordinance and should be documented accordingly.
Commissioner Fritz Najarian questioned whether the deed provided met the township’s ordinance requirements and noted that a deed from 1953 appeared to be missing; Scherzberg said he had also pulled a 1969 deed in his review. Najarian recommended adding explicit plan language restricting any future subdivision. Willard Dellicker recommended the feasibility study could move forward to a preliminary plan, subject to Karl Scherzberg’s comments being addressed and with the inclusion of a no-further-subdivision designation; Najarian seconded, and the motion passed unanimously.
The Commission did not record any public comment on this agenda item. The next procedural step is submission of a preliminary plan that incorporates the engineer’s requested corrections and the required deed/notation language; the commission’s recommendation is advisory to any required county or state reviews.
