Village steps aside as state reviews structure at Stop 42 after resident concerns

Tim McCarthy, a Village of Michiana council member, announced the council would "be stepping down" on the issue of the structure at Stop 42 while the State reviews the situation, and moved the item as new business. He said the State is handling the matter and the Village will await further direction from State authorities.
During the public-comment portion focused on agenda items, Kathleen Hogan Morrison asked whether the Village was "doing nothing about the structure on 42." McCarthy responded that the council must "let this play out" and that he could not direct individual residents on whether to contact the State agency EGLE. Property owner Caroline Rogers told the council she had "applied for a permit with EGLE and the Building Department" and said she "was not trying to be defensive but she didn’t know she was doing anything wrong." Resident Bill Schutt observed that the Village owns the roads in the area and that a road still exists where the structure was built.
Building Inspector Bill Lambert said the structure on 42 had been permitted to a different address than where it was actually constructed, a permitting discrepancy the council and staff will need to follow up on. Several residents, including Lynn and Joel Altschul, expressed "extreme concern" about the structure on the beach at 42.
The council did not take any further action at the meeting and has deferred to the State review. Next steps reported at the meeting: the State review remains pending and the Village will await the State’s findings before resuming local action.
