Warner — Town Meeting voters approved a revision to Article XV (Non-Conforming Use) of the Warner Zoning Ordinance to add separate subsections for non-conforming lots, non-conforming structures and non-conforming uses, and to tighten language about frontage, setbacks, permitted alterations and restoration following disaster.
The warrant text describes specific conditions under which non-conforming lots may be built upon, including minimum frontage percentage, the ability to sustain a state-approved waste-disposal system, and compliance with district setback requirements. The amendment also clarifies when non-conforming uses may continue, when they lapse after discontinuation, and conditions for restoration of destroyed structures within three years without creating a new or expanded non-conforming use.
The Planning Board recommended adoption by a 4–2 vote. The paper-ballot tally recorded 432 votes in favor and 242 opposed; Article 3 passed.
The ordinance text as adopted will be part of the town zoning ordinance; implementation and any subsequent permitting will follow the town’s zoning and building-permit processes.
