Cedar Lake commission votes to pull performance bonds for Summerwinds subdivision to finish sidewalks and infrastructure

The Cedar Lake Plan Commission moved on June 17 to pull performance letters of credit covering Units 1–3 of the Summerwinds subdivision after developer counsel declined to renew the performance bond and instead offered only a maintenance letter of credit.

Commissioners and multiple residents described incomplete sidewalks and driveways, and said some panels had already been removed for work. Town staff said the developer submitted a maintenance LOC but did not provide the $50,000 performance bond the commission had relied on as a condition of prior approvals. After lengthy debate about enforcement options and the legal consequences of pulling a performance bond, the commission voted to set a full date to act and to pull the relevant performance letters so the town can secure funds to complete necessary sidewalks and infrastructure.

Town staff explained that funds drawn on the letters would be deposited into a town account and used to complete outstanding work and that any residual accounting and inspection would be handled according to standard town practice. Commissioners cautioned residents that fund proceeds may be insufficient to complete all outstanding infrastructure and that the town would then prioritize critical repairs; residents asked the town to act quickly to restore driveway access for affected homeowners.

The motion to pull the performance letters for Units 1–3 carried. Staff will compute exact draw amounts, notify the bond issuer and schedule contractor work as funds allow. The commission said it will provide updates to residents as work is scheduled.
