Emigration Canyon Planning Commission reviews draft development-agreement and conditional-use ordinances, schedules vote

The Emigration Canyon Planning Commission on May 14, 2026 held study-session briefings on two ordinance updates that staff said are intended to clarify development agreements and conditional-use rules.

Claire Gillmor, planning staff, reviewed a proposed Chapter 19.03 on Development Agreements and a replacement draft of Chapter 19.84 on Conditional Uses. Gillmor said state law prevents the city from requiring a development agreement for every subdivision and advised commissioners to keep ordinance language plain until specific applications—where individual impacts can be placed on the record—arrive.

Gillmor told commissioners to review the enacted one-page version of 19.03 and the four-page draft of 19.84 and to email comments to staff before the next meeting. She also said staff will document commission recommendations in a table and present those comments alongside the ordinance to the City Council.

During the discussion, staff noted a pending state-level proposal the transcript describes as legislation that could treat oil-and-gas pipelines as a permitted use in every city; Gillmor urged commissioners to consider how the city should respond if that state action proceeds.
