The Judicial Nominating Commission voted to certify former judges Michael Pagano and David Welch as senior judges during a public meeting, following a staff recommendation based on applications included in the meeting materials.
A staff member told commissioners that both applicants met the statutory requirements and the exceptions listed in Administrative Rule 5(b)(3) subsections a–g and recommended certification. "We are recommending approval of both judges, Judge Pagano and Judge Welch, for certification as senior judges," the staff member said.
The commission's chair moved to approve the certifications and clarified the effect of certification: "To certify someone as a senior judge does not mean that they will serve as a senior judge. It's up to the discretion of the trial court judges whether they will do that, and then certification is required each year thereafter," the chair said.
A motion to approve certification of Michael Pagano and David Welch was made and seconded. The commission took a voice vote; members responded "aye" and no opposition was recorded. The chair declared the certifications approved.
With no further public business, the chair adjourned the public session and the commission proceeded to the judicial qualifications agenda in executive session.
