Council authorizes formal enforcement action under nuisance ordinance

Town legal staff explained the next step is a formal civil enforcement action that can produce a court order requiring abatement and, if the owner fails to comply, allow the town to abate the nuisance and place a lien for costs. “The way our nuisance ordinance reads is the next step would be for an enforcement action, which is a formal lawsuit,” the town attorney explained.
Council members discussed options for informal resolution and noted that filing often prompts property owners to engage with the town. After discussion a motion to pursue enforcement was seconded and passed by voice vote.
Next steps: the town attorney will file enforcement documents and continue to seek informal resolution where practicable; staff may contract commercially reasonable means to abate nuisances if ordered by the court and then recover costs through a lien.
