The Rio Communities City Council on June 22 discussed, but ultimately tabled, a mayoral proclamation to ban fireworks for the upcoming July 4th holiday.
City Attorney (legal counsel) told council the proclamation’s publication requires at least 20 days’ notice under the cited statute and recommended caution given the timing. City Manager Dr. Moore noted the city is under a declared drought emergency but also reminded council that a statewide burn ban is already in effect and can be enforced by local fire and police.
Councilor Nelson moved to table the proclamation because the 20‑day notice requirement had not been met; the motion passed after the mayor cast the deciding vote when the council was split. Dr. Moore said police and fire department staff would be prepared to patrol and enforce fire restrictions over the holiday and that the fire department could issue citations under fire code.
Because the proclamation was tabled, the city will rely on the existing statewide ban for enforcement and staff said they would remind the public that open flames and fireworks are prohibited while drought conditions persist.
