Staff will file expedited rule amendments on snack-bar wine, theater seating and cannabis fees

Kevin, a rules team representative, reviewed the rules team's work and previewed a set of expedited filings staff will ask the board to file tomorrow to implement three bills passed earlier this year.
Kevin said staff will request filing of CR103s to implement House Bill 1526, which allows snack bar licenses to serve wine by the glass; House Bill 2476, which raises the maximum number of seats a theater may have to qualify for a spirits/beer/wine theater license from 120 to 200; and Engrossed House Bill 2681, which increases licensing fees for cannabis producers, processors and retailers. He said these rules qualify for expedited rulemaking because the statutory changes dictate the rule language.
On public comment, Kevin said the CR105 filing (published April 22 and in the Washington State Register on May 6) produced one comment related to House Bill 2476 asking to amend the statutory electronic ID scanner requirement to allow alternative ID-verification methods during a power or software failure. Kevin said the agency consulted enforcement staff and E&E and concluded it could not change the statutory requirement in rule, but enforcement staff would use discretion: "if the failure to use the electronic ID scanners was the result of a licensee's control, no violation would be issued," and officers would generally offer education and time to come into compliance.
Kevin said the proposed expedited rules were published and that, if approved tomorrow, staff would file with the code reviser's office and the rules would become effective immediately under the expedited process. He invited questions; none were raised during the caucus.
Next steps: staff will ask the board tomorrow to approve filing the CR103s; the advertising rules implementing Senate Bill 5206 will take effect July 3, and other filing and adoption timelines described during the update remain on staff's schedule.
