The Henry County Commission on March 16 approved Resolution 6-3-26 authorizing the county to retain outside counsel to represent a named county official in a federal lawsuit captioned Allegheny Casualty Company v. Hon. J. Brent Bradberry, et al.
Exhibit A attached to the record identifies the proposed firm and sets a $200-per-hour billing rate, monthly invoicing, pro-rating of time where counsel represents multiple clients in the matter, and reimbursement for out-of-pocket expenses including travel. The engagement letter indicates counsel will notify the county promptly if any conflict arises requiring action.
Commissioner Charles Elizondo moved to approve the retention and Commissioner Jay Travis seconded. The motion carried. The resolution authorizes the county mayor to execute the engagement letter and directs that the engagement be recorded in the county’s files.
The record shows counsel will represent the defendant official in his official capacity; the exhibit notes counsel already represents other circuit court clerks in the same case and anticipates no conflict but will notify the county if one develops.
