Borowsky (maker of amendment A03740) described the amendment as sector-specific, adding safety as a standalone factor, narrowing the scope to rate proceedings and major infrastructure decisions, and extending certain rate-case deadlines. Members debated the inclusion of environmental justice and potential effects on reliability, regulatory certainty and litigation risk. Some members called environmental-justice language a salutary addition; others warned it could be a "poison pill" and create uncertainty.
