Green Township adopts ordinance to sell two undersized parcels to adjoining owners

The Green Township Committee on Sept. 3 adopted Ordinance 2025-08, authorizing the public sale of two township parcels — Block 107, Lot 6 (5 Crescent Road) and Block 76, Lot 5 (161 Decker Pond Road) — in a public auction limited to contiguous property owners under N.J.S.A. 40A:12-13.
The ordinance sets minimum sale prices of $15,000 for Block 107, Lot 6 and $20,000 for Block 76, Lot 5 and requires that any purchased parcel be merged with the buyer’s contiguous lot. The sale will be conducted "as is," the ordinance states, and successful bidders must deposit at least 10 percent of the bid at the time of sale and pay the balance, legal fees and recording costs within 30 days after the Committee confirms the winning bid. The township also reserves the right to reject bids.
During the public hearing on the ordinance, property owner Brett Estell said some contiguous owners were not contacted initially about a donation to Habitat for Humanity and that owners across County Route 517 had not been notified. Township Clerk Mark Zschack responded that adjoining property owners had been mailed notice and that the township would send the proper legal notice of the public sale.
The ordinance includes standard municipal sale conditions: no title warranty (quitclaim deed), sale subject to matters of record and zoning, a $570 legal-service charge to be paid by the buyer at closing, and an explicit requirement that bidders be current on township taxes and utility charges. The sale is scheduled for Oct. 6, 2025 at the Green Township Municipal Building unless the Committee adjourns or changes the date.
The Committee closed the hearing and adopted the ordinance by unanimous roll-call vote. Ordinance 2025-09 on land-use standards was carried to the Sept. 15 meeting to allow Land Use Board review.
