Groveland planners approve 1 Elm Park special permits; applicant agrees to reimburse re-advertising fee

The Groveland Planning Board on July 7 ratified a memorandum decision authorizing special permits for 1 Elm Park after the applicant agreed to repay the town’s re-advertising cost.
John Guilfoyle, owner of FKG Properties LLC, told the board the application is unchanged from the May presentation and that financing is lined up. "Nothing has changed... What I am seeking from you tonight is to revote on that and to hopefully accept the draft decision," Guilfoyle said, asking the board to sign the draft planner-prepared decision to satisfy his lender.
The application seeks to add four dwelling units on the building’s third floor, reduce required parking by one space under Section 50-9.4 of the Groveland bylaw, and include one affordable dwelling unit under Section 50-10.1, while also requesting a waiver from site plan review. The town planner described only clerical updates to the draft (dates and clerk’s stamp) and said the substantive project materials remain the same.
Board members questioned why the town paid roughly $700 to re-advertise after a missed time stamp. Several members said applicants must ensure paperwork is complete and that the onus generally falls on property owners. After discussion Guilfoyle said he had been told his application was complete when he filed and agreed he would reimburse the town for the second advertising mailing to avoid further delay.
With that stipulation, the board moved to endorse the memorandum decision with the waiver request and to approve the special permits for the parking reduction and the inclusion of the affordable unit. The motion carried by the board and members recorded the vote as unanimous. The memorandum decision will be prepared for signatures that evening or the following day so the applicant can proceed with financing steps.
The board set no additional conditions beyond those in the memorandum and confirmed the approvals will be available for signing immediately to help meet the applicant’s bank timeline.
