Trustees amend JEDD agreement to allow use of maintenance fund for township service vehicles

The Brimfield Township Board of Trustees voted unanimously on March 16 to adopt Resolution No. 2026-133, amending portions of the July 7, 2003 Brimfield Township–City of Tallmadge Joint Economic Development District (JEDD) contract to clarify permitted uses of the JEDD "Maintenance and Improvement" (MCI) fund.
The resolution, moved by Trustee Sue Fields and approved by roll call, revises Section 7.1 to state that the MCI fund may pay for maintenance and capital improvements "including the purchase of Township Police, Fire, and Road Department vehicles to be used, in whole or in part, within the area of this JEDD." It also restates Section 15(1) to confirm a 55% share for Tallmadge and 45% for Brimfield and that each party will contribute 5% of the total JEDD revenue to the MCI fund. The resolution is explicit that the amendment applies retroactively to Jan. 1, 2024.
According to the resolution text presented at the meeting, Section 7.1 establishes the fund at a minimum 10% of income tax collected within the district and allows the parties, by ordinance or resolution, to adjust that rate within 60 days of one another. The trustees also authorized the township fiscal officer to take necessary steps to implement the amendment once Tallmadge enacts a matching modification consistent with the JEDD contract.
The measure passed on a roll call vote with Trustees Nicholas Coia, Sue Fields and Kevin Scott recorded as voting yea.
Why it matters: The change explicitly permits use of shared JEDD MCI funds for vehicles that serve the JEDD area, which could shift how capital needs for public safety and roads are funded within the district. The resolution also clarifies contribution mechanics and the intended 55/45 revenue split between Tallmadge and Brimfield.
The board did not specify particular vehicle purchases at the meeting. The resolution states it shall take effect upon adoption or at the earliest period allowed by law, subject to Tallmadge's corresponding action.
