Chair Jim Monteverdi said the petitioner submitted a letter reporting that certain abutters did not receive required legal notice and requested a continuance to Jan. 15, 2026. The board considered the request and attached conditions meant to ensure renewed notice and allow time for local discussion.
Under the motion, the board continued case BZA1188742 (514 Franklin Street) to Jan. 15, 2026, on three conditions: the petitioner must update the posted notice to show the new date and the 6 p.m. start time; the petitioner must sign a waiver of statutory hearing-timing requirements (a waiver available from Maria Pacheco or Olivia Ratai at the Inspectional Services Department) and return it within one week of the coming Monday; and any new submittals or changes to drawings or dimensional forms must be filed in the case file by 5 p.m. on the Monday before the continued hearing. The chair said failure to return the waiver within the time specified would result in a de facto adverse ruling.
The motion to continue passed unanimously by voice vote, with board members Carol Agate, Zaria Miranda, Michael LaRosa, Daniel Gonzales and Jim Monteverdi recorded in favor.
The case remains scheduled for the board’s Jan. 15, 2026 meeting.
