The Town of Pleasant Valley Planning Board on July 8 conditionally approved a six-lot preliminary subdivision plat (Joyce Subdivision) and required a recordable deed restricting further subdivision of the lots before the plat may be signed.
An applicant who arrived late said he had made minor updates to the site plan — moving the house back roughly 20 feet and adding screening trees — and confirmed acceptance of a deed restriction preventing further subdivision of the lots. A board member asked for explicit language so the deed would be recorded promptly after the plat is filed; the board included that clause in the resolution.
The board’s conditional approval lists multiple preconditions to signature and construction: payment of all applicable fees (including the town recreation fee for five new additional lots), Dutchess County Department of Health approvals for wells and septic systems, submission of driveway permits per Town Code chapter 46 and recordable common driveway maintenance agreements acceptable to the board’s engineer and attorney, a New York State Department of Environmental Conservation (DEC) stream crossing permit, a town wetlands permit (or board approval if the wetlands administrator does not issue one), and a NYS DEC wetlands jurisdictional determination. The chair also stated the applicant must file a pre-construction notification with the U.S. Army Corps of Engineers for a nationwide permit before commencing construction.
The board approved the resolution by motion and voice vote with no nays. The conditional approval is valid for 180 days and may be extended twice for up to 90 days each upon timely request and board approval. The chair will endorse the subdivision plat after the applicant meets all listed conditions.
