Mannington Committee approves routine business, names pension certifying officer and schedules closed-session litigation update

The Mannington Township Committee on Oct. 3 approved routine business, adopted personnel and administrative resolutions, and scheduled a closed session on pending litigation.
Committee member Dunham moved and Mayor Asay seconded approval of the attached bill list and the minutes of the Sept. 5, 2024 meeting. The minutes record affirmative votes by Asay and Dunham on those procedural motions.
The Committee adopted a resolution designating Diane Elwell, chief financial officer, as the Certifying Officer for the Township for matters relating to the New Jersey State-administered retirement systems for calendar year 2024 and naming Amber Ayars, Acting Clerk, as Supervisor of the Certifying Officer; the resolution states both completed the state-mandated training required under N.J.S.A. 43:3C-15.
The Committee also adopted a closed-session resolution directing that the public be excluded for discussions concerning pending or anticipated litigation and contract negotiations. The minutes identify specifically: (1) review of an update from JDA legal counsel regarding litigation filed by the Borough of Montvale challenging certain New Jersey affordable-housing requirements in which Mannington Township is a plaintiff, and (2) other matters falling within attorney-client privilege. The resolution states that no action will be taken during closed session and that matters will be disclosed when confidentiality no longer exists.
Public Works submitted a written report noting a fence installation on Roure 45, cleanup of limbs and debris at the Public Works building, and completion of Bassett Road repair. Zoning Officer Robert Schmid submitted a written report: an attorney for the property at 44 Route 45 indicated a variance application would be filed by Oct. 4 related to an addition and gazebo built without zoning approval; Solicitor Horner reported the SMS Rail Services, Inc. matter was dismissed without prejudice by Judge Whitcraft and could be refiled pending a Federal Surface Transportation Board determination; Mayor Asay mentioned the Penton Station Road property with about 400 cars remains in court and that Attorney Coe may attend the November meeting for an update.
Financial receipts were reported for September as follows: Tax Collector receipts $133,901.03; Mid-Salem County Court check $856.08; Registrar receipts $1,638.00; Finance reported receipts totaling $1,317,792.65. The meeting was adjourned at 6:11 p.m.
