Mannington awards Yorktown Road resurfacing contract to South State after low bid rejected for disclosure defect

The Mannington Township Committee on Oct. 3 voted to accept the Base Bid from South State, Inc., in the amount of $238,218.70 for the "Mannington Yorktown Road Resurfacing (LTPF)" project.
The award followed a review of four bids. The Township Engineer, Robert A. Mulford, P.E., C.M.E., of Fralinger Engineering, confirmed Bogey's Trucking & Paving, Inc. submitted the apparent low bid of $225,552.00 but that bidder’s submission failed to satisfy the corporate-disclosure requirements of N.J.S.A. 52:25-24.2; Solicitor Horner advised the defect was nonwaivable under the statute. Mulford recommended awarding to the next-lowest, responsible bidder, South State, Inc., and noted the bid materials and quantities were acceptable.
The minutes record that the Committee understood the township has a New Jersey Department of Transportation grant of $335,000 to cover construction, inspection and material testing costs for the project. The award was made subject to the Township Solicitor’s review and approval of contract documents, confirmation that insurance requirements are satisfied, and the Township Treasurer’s certification of available funds. The Mayor or Deputy Mayor and the Acting Clerk or Deputy Clerk are authorized to sign required NJDOT recommendation-of-award forms and, once conditions are met, to sign the contract.
Committee member Dunham moved the resolution to accept the bid; Mayor Asay seconded. The roll call in the minutes shows Asay — yes; Dunham — yes.
Next steps: the clerk was directed to return signed NJDOT recommendation forms to the Township Engineer for submission to NJDOT, and the Township will finalize contract documents after solicitor and treasurer approvals. A public hearing on the project is scheduled for Nov. 7, 2024 at 5:30 p.m.
