The North Castle Planning Board voted May 28 to approve the site plan, steep-slope application and stormwater measures for 6 Massaro Court, a three-lot subdivision whose final lot is proposed for a two-family house.
Michael Stein of Hudson Engineering told the board the project is the last of three approved lots and described drainage measures and retaining walls needed to access driveways. Stein said utilities are in the street and the team will install a stormwater management system to treat runoff from the house and driveways.
The town engineer and staff flagged one remaining technical issue: condition 6 in the draft resolution requires the grading plan be revised to eliminate a seven-foot exposed basement and to the satisfaction of the town engineer. As staff explained, that revision could require minor grading and wall adjustments but should not change the overall building or driveway locations.
A board member also asked who would be responsible for future retaining-wall maintenance; the applicant and staff said the wall would be wholly on the applicant’s property and recommended the resolution clarify that the property owner is responsible for upkeep to avoid future disputes.
After discussion, the board closed the public hearing and approved the resolution as amended to include the engineering condition. Chair moved to adopt the resolution and members voted 'Aye.' The transcript records that the motion was seconded and carried, but individual tallies were not attributed to named members in the public transcript.
Next steps: the applicant will revise grading plans for the town engineer’s review and the condition must be satisfied prior to final administrative sign-off.
