The Town of Hubbardston Planning Board determined a submitted plan met the requirements for an Approval Not Required (ANR) endorsement under MGL chapter 41, section 81P but authorized the chair to sign the plan only after the applicant either revised the plan to show existing structures or filed a signed attestation that none exist.
Town planner Alec had reviewed the application and recommended the plan be accepted administratively, noting it “substantially complies with the requirements of section 402” of the subdivision rules and regulations but that the plan did not explicitly indicate whether buildings exist on the property. Chair Christopher Monroe summarized the board’s action: the board would authorize the chair to endorse the plan subject to the applicant revising the plan to either depict existing structures or file an attestation that no structures exist.
A board member clarified parcel geometry and frontage: members discussed that the proposal covered approximately 3.84 acres within the larger Lot 39 boundary and left sufficient frontage for two estate lots and room for a road. A member moved to follow the planner’s recommendation and authorize the chair to sign subject to the revisions; another member seconded the motion and the board approved it by roll-call vote.
The board’s motion specified the endorsement was made under MGL chapter 41, section 81P (the “Approval Not Required” provision). The chair said he would sign the plan on behalf of the board once the applicant provided the required plan revision or attestation; the planner also noted this meeting was the last opportunity before the application would be administratively accepted absent the change.
