A developer has requested an amendment to the Foxfield 6 annexation agreement that would allow construction of the water treatment plant, the first phase of infrastructure and a model home/sales office to proceed at the same time, town staff said Feb. 23.
Under the original annexation agreement, the water treatment plant was to be built and operational and the first phase of infrastructure completed before other building construction could proceed. The draft amendment has been updated to note that a long‑term pump drawdown test has been completed and that two existing wells are available.
The Director of Public Works told the board that the original appropriation permitted each listed six wells, but negotiations with the Maryland Department of the Environment reduced that number to four wells with two additional reserve wells. The Director recommended keeping the well total at four.
Town staff said the Town Attorney has been sent the amendment documents and will be asked to attend the March workshop. The developer will also be notified and asked to attend. No formal motion or vote was taken at the Feb. 23 meeting; the item was continued for legal review and further discussion at the workshop.
Next steps: the Town Attorney will provide an opinion and participate in the March workshop; the board will revisit the amendment after legal review and the developer's attendance.
