Planning board approves 23-unit redevelopment project with conditions; off-site parking and easements required

The Pompton Lakes Planning Board voted to approve a redevelopment application for a 23-unit residential building, concluding the application had been previously reviewed by the redevelopment agency and county and found to conform to the redevelopment plan.
Applicant counsel (speaker 10) told the board the building will contain 23 units and that the redevelopment agreement renders the plan "as of right" (no design waivers or variances). The project team described 26 on-site parking spaces for tenants, plus an additional eight off-site spaces to be provided under a license or easement with county property; the applicant said negotiations with the county were advanced but that final signed agreements would be conditions of approval.
Project engineer Marvin R. Blethen (speaker 7) reviewed plan revisions and compliance items, including EV-charging calculations (15% EV requirement leading to four on-site EV spaces and additional off-site EV in the county lot), drainage adjustments and DEP coordination on the floodplain and impervious area changes. He testified the project had a previously issued DEP permit and that only a de minimis amendment would be required.
During the board's motion and roll-call vote the board approved the project with conditions that recorded easements, final county licensing for the eight off-site spaces, confirmation of EV and ADA spaces and resolution-compliance engineering sign-offs must be provided before final permits and construction. The roll call recorded one negative vote (Keating); others voted in favor.
